This Legal Notice identifies the legal entity responsible for the websites and services of EvoCODE IA® and consolidates the official contact channels, including that of the Data Protection Officer (DPO). It forms part of the EvoCODE legal hub, together with the Terms of Service, the Acceptable Use Policy (AUP), the Privacy Policy, the Cookie Policy, and the DPA. In the event of a conflict between documents, the following order of precedence applies: DPA > Terms of Service > AUP > documentation.

The DPO was designated by a formal act of EvoCODE IA® Ltda, pursuant to Article 41 of the LGPD (Lei Geral de Proteção de Dados — Brazilian General Data Protection Law, Law No. 13,709/2018) and to Resolution CD/ANPD No. 18/2024, which requires the public disclosure, in a clear and objective manner, of the identity and contact information of the DPO — which we do in the highlighted section above.

Duties of the DPO (Article 41, paragraph 2, LGPD):

• accepting complaints and communications from data subjects, providing clarifications, and taking action;
• receiving communications from the Brazilian National Data Protection Authority (Autoridade Nacional de Proteção de Dados — ANPD) and taking action;
• advising EvoCODE's employees and contractors on personal data protection practices;
• performing any other duties assigned by EvoCODE or established in supplementary rules issued by the ANPD.

How to exercise your rights: data subject requests (confirmation, access, rectification, anonymization, portability, erasure, information on data sharing, withdrawal of consent, and the other rights under Article 18 of the LGPD) must be sent to dpo@evocode.ia.br. We respond to confirmation and access requests in simplified format immediately or, in complete format, within 15 days, and to the remaining requests within a reasonable period, in accordance with the LGPD and ANPD guidance.

Note on processing roles: in part of the processing activities, EvoCODE acts as a processor on behalf of its customers (tenants) — for example, data of scheduling invitees in Kairo and the content of conversations handled by AgenteNOC. In such cases, the controller is the customer, and we may redirect your request to them, providing the necessary assistance. Details are set out in the Privacy Policy and in the DPA.

4. Official channels

The only official communication channels of EvoCODE IA® are those listed in Section 1 and the DPO's e-mail address in Section 3. Messages received from other numbers, e-mail addresses, or profiles must not be presumed to originate from EvoCODE. We do not request passwords, authentication codes, or payment details via WhatsApp or e-mail.

5. Intellectual property

The trademarks EvoCODE IA®, Kairo, TraceLog, and AgenteNOC, as well as the logos, layouts, software, and content of the websites and products, are owned by EvoCODE IA® Ltda or licensed to it, and any unauthorized reproduction or use is prohibited. The license terms governing the use of the products are set out in the Terms of Service.

6. Compliance

EvoCODE IA® Ltda maintains a privacy and data protection governance program aligned with the LGPD and with ANPD resolutions (including Resolutions CD/ANPD No. 15/2024 — security incident notification, No. 18/2024 — Data Protection Officer, and No. 19/2024 — international data transfers) and, where applicable to users in other jurisdictions, with the regional sections of our Privacy Policy (EEA/United Kingdom, USA, Canada, and Latin America). Information on the use of AI agents, identification of synthetic content, and automated decision-making is set out in the Privacy Policy and the Terms of Service.

This notice may be updated at any time; the version and date at the top indicate the edition currently in force.
